The Constitutional Court of Kosovo stated Thursday evening that the President's contested decree complies with paragraph 2 of article 82 of the Constitution, thus concluding that the positive vote of a motion of no confidence by the Assembly against the government does not imply the mandatory dissolution of the parliament and allows the formation of a new government in accordance with article 95 of the Constitution.
The Court further states that the contested decree complies with paragraph 14 of article 84 of the Constitution in relation to paragraph 4 of article 95 of the Constitution.
The decision of the Constitutional Court yesterday evening comes after the request for the movement Vetëvendosje to evaluate the constitutionality of the decree of President Thaçi, who had appointed another premier to form the new government.
On April 30, the president Thaçi he had issued a decree proposing to the Kosovo parliament, Avdullah Hoti of the Democratic League, as premier designated for the formation of a new government in Kosovo.
President Thaçi welcomed the Court's decision on Thursday evening, inviting political parties and all institutions to show political maturity, respect and commitment to the law and order and institutions of the Republic of Kosovo.
“They must respect, accept and implement the decisions of the final authority for the interpretation of the Constitution and the compatibility of laws and other acts with the Constitution. Kosovo faces many challenges, so now we should not waste any more time in forming the new government, with full legitimacy on the part of the Kosovo Parliament, "he wrote on social networks.
The premier in office is of a different opinion Albin Kurti who reacted through a Facebook post on the decision of the Constitutional Court, which yesterday declared the decree of President Thaçi constitutional, to give the LDK the right to form a new government.
Kurti writes that "unfortunately, the Constitutional Court has sided with the usurpers of the state", that the decision is unprecedented in the democratic world, and that the decision goes beyond the imagination of any logical and legal level.
