Through a letter, the head of state Ilir Meta asked the president of the Venice Commission - Gianni Buquicchio - to reflect on the draft opinion which states that the Albanian president has violated the constitution, stating that all this could negatively affect the resolution of the political crisis in the country.
Meta also asked that the issue take full account of all members of the Commission as it arrived at a time when the grave crisis in the country was moving towards a solution:
"Given the unprecedented situation in which my country is today, where none of the constitutional institutions of the judicial system that guarantee control and balancing of powers is not in operation, and in conditions in which the serious crisis seems to be heading towards a solution thanks to more authorities of the main European partner countries, I would ask that the analysis of this issue receive the utmost attention from all members of the Commission."- said the President in the letter.
Last September 27, the Venice Commission had announced his opinion regarding the annulment of the 30 June 2019 local elections in Albania by Meta, stating that the President of the Republic Ilir Meta had gone beyond his constitutional powers by canceling the elections and indicating others, but also that the gravity of the acts was not such to justify impeachment.
Previously , Meta himself had declared that he would resign if the Venice Commission had evaluated his anti-constitutional actions.
Ilir Meta's response to the position taken by the Venice Commission is mainly based on the fact that, in his opinion, the Commission does not have a thorough knowledge of the political situation in Albania:
"[...] I find it appropriate to stress that only a thorough knowledge of the situation in Albania would allow an objective assessment of the president's constitutional activity.
I reinforced this belief during the meeting held with reporters in Tirana of the Venice Commission, who openly expressed their concern about not knowing either the history or the context of the events, considered key elements for the correct interpretation of the constitutional activity of the President of the Republic. "
The president of the Albanian Republic defines the draft "contradictory" and "a priori guided by some fixed ideas of the Commission", as well as "unbalanced and incomplete". Furthermore, he accuses the members of the Commission of having drawn conclusions that go beyond their mandate and of interfering in the assessments of the OSCE-ODIHR, the highest institution authorized to monitor and manage electoral issues, not citing in the analysis any of the 3 reports that the OSCE-ODIHR drafted during the election monitoring in Albania
