The Albanian Civil Aviation Authority (AAC) has published an official press release regarding the Italian airline "Ernest Airlines", to which from 13 January license suspended of air transport exercise.
The AAC announces that it has contacted the Italian Civil Aviation Authority (ENAC), its Italian counterpart, for clarification on the situation, which in turn reported having been forced to adopt this measure due to the financial problems of the airline company.
The measure was adopted by ENAC on the basis of the provisions of Regulation (EC) no. 1008 of 2008, containing common rules for the provision of air services in the European Community. However, if the carrier provides the guarantee elements required by the community rules and these elements are favorably assessed by the Body, the suspension measure can be revoked.

"Following the announcement of the Italian National Aviation Authority on the suspension of the license of the 'Ernest' company, as the authority responsible for the company's license, the Albanian Civil Aviation Authority (AAC) sent a request to ENAC and we have been informed that, due to the company's financial difficulties, the Italian authority was forced to take this decision in the hope that 'Ernest', by January 13, 2020, will be able to demonstrate the financial guarantee necessary for the continuation of the 'activities.
The company 'Ernest', for its part, has reported to the AAC that it will undertake to take the necessary measures to guarantee the normalcy of flights until 13 January. As indicated above, since the announcement of the suspension of the license, the company has been operating with limited capacity as regards aircraft and on-board staff. This situation has also led to the cancellation and rescheduling of flights, but so far not to total interruption. [...]
- Passengers who will not be able to fly on "Ernest" rescheduled flights are recommended to request a refund from the airline through the system on their website.
- The refund request must also be made by passengers who booked a ticket after 13 January 2020.
- It is very important that passengers make their refund requests as the only protection mechanism available to them according to EU rules.
[...] The AAC is following the situation of the Italian company "Ernest" and will continuously request the company and the Italian authority to respect the rights of the passengers concerned, as the authority responsible for the company's license. The AAC, in accordance with European and Albanian legislation, which regulates the rights of passengers, regarding the situation that the company is going through, will publish updates in order to help passengers in their decisions."- reads the press release published on Facebook by AAC.
