To the detriment of the clarity and goodness of the law under consideration, the bureaucracy and its sadly known delays do not always allow an easy application of the protections provided therein in favor of minors and their families.
This is, at least, what happened in the case of the small Aria (of which we had already spoken a few weeks ago) and of his mother who had been waiting for a reply from the Court for about a year and a half.
What the law requires
PERMANENT AUTHORIZATION IN ITALY PURSUANT TO ART. 31 OF THE D. LGS 286 / 1998 (YOU IMMIGRATION)
Article. 31 of the Consolidation Act on immigration, in its third paragraph provides that "The Juvenile Court, for serious reasons connected with the psychophysical development and taking into account the age and health conditions of the minor in the territory Italian, may authorize the entry or stay of the family member, for a fixed period of time, also in derogation of the other provisions of this law. The authorization is revoked when the serious reasons justifying the release or for activities of the family member cease incompatible with the needs of the child or with the stay in Italy. The measures are communicated to the diplomatic or consular representation and to the quaestor for the fulfillment of their respective competences ".
The disease of the little Aria
The child, suffering from severe congenital anemia (called Diamond-Blackfan), periodically under medical supervision and continuously subjected to blood transfusions, was on a waiting list to undergo a bone marrow transplant at the Bambino Gesù in Rome.
The appeal filed by the parents at the Juvenile Court of Perugia to obtain a residence permit that would allow Aria to undergo surgery and the mother to be able to accompany her on this difficult journey was, by now, pending from the month of February of the 2018 and unfortunately did not reach a decision by the judges.
Thanks to the enormous diffusion that its history has received on social networks and on our page, many people have given their own contribution that was indispensable for Aria and her family. The multitude of people who have given their precious help have also joined theAvv. Elierta Myftari of the Milan Forum which, free of charge, offered legal assistance to the family.
In particular, given that Aria's health conditions did not allow further expectations, appointed by the mother of the child as defender in the pending proceedings, the lawyer Myftari presented to the Juvenile Court of Perugia an application through which he requested the urgent issue of an acceptance order.
After sun (so to speak) three weeks from the instance, with decree n. 860 / 2019, pronounced on 6 June and deposited on 12 June 2019, the Juvenile Court of Perugia has finally authorized the small and her mother to remain in the territory of the State so that the child can be subjected to the intervention and also obtaining subsequent care, which is essential for her recovery.
The good news does not stop there. In fact, we learned that the Bambino Gesù Hospital in Rome was able to find a donor marrow compatible with Aria and that, in all likelihood, in early July, the baby will be transplanted. This story teaches us that networking, especially for a just cause, helps and that distant people can stay close to each other in so many beautiful ways.
